By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. No Doctor-Patient Relationship Created by the Site

Use of the Site, including submitting a contact form, appointment request, or patient referral form, does not by itself create a doctor-patient relationship between you and NEO Surgical Group or any of its physicians or staff. A doctor-patient relationship is established only once we have confirmed an appointment and you have been evaluated in person (or via a scheduled telehealth visit, if offered) by one of our providers.

Submitting information through the Site does not guarantee that we can accept you as a patient, schedule a specific appointment time, or provide any particular treatment.

3. Medical Disclaimer

The Site is provided for general informational purposes only. Content on the Site — including descriptions of conditions, procedures, and services — is not medical advice, is not a substitute for professional medical evaluation, and should not be used to self-diagnose or self-treat any condition. Always seek the advice of a qualified physician regarding any medical condition or before starting, changing, or stopping any treatment.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Site's contact form, appointment request, or any other feature of the Site to seek help for a medical emergency — messages submitted through the Site are not monitored in real time and are not an appropriate channel for urgent or emergency medical concerns.

We do not guarantee any particular outcome, diagnosis, or result from any procedure, treatment, or service referenced on the Site. Individual results vary based on each patient's circumstances. Information on the Site should not be relied upon as a substitute for an in-person evaluation by a qualified physician.

6. Intellectual Property

All content on the Site — including text, images, graphics, logos, and layout — is the property of NEO Surgical Group or is used with permission of the rights holder and is protected by applicable copyright and intellectual property laws. No content may be copied, reproduced, or distributed without the Practice's prior written consent.

7. Third-Party Links and Widgets

The Site may contain links to, or embed content from, third-party services (including a Google reviews widget and other social media links). The Practice is not responsible for the content, accuracy, or privacy practices of any third-party site or service and does not endorse them by linking to or embedding them.

8. Limitation of Liability

To the maximum extent permitted by law, NEO Surgical Group shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site. This limitation does not apply to, and nothing in these Terms limits, any liability arising from the actual provision of medical care once a doctor-patient relationship has been established, which is governed separately by applicable Florida medical malpractice law and your care agreements with the Practice.

9. Binding Individual Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (but not any claim relating to the actual provision of medical care, which is excluded from this arbitration provision and governed separately by applicable law) shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court where eligible.

Class Action Waiver. You and the Practice agree that any arbitration or proceeding under this section shall be conducted only on an individual basis and not as a class, collective, consolidated, or representative action.

Opt-Out Right. You may opt out of this arbitration agreement by sending written notice to the Practice at the email address in Section 11 within 30 days of the date you first accepted these Terms. Your notice must include your name, the phone number or email address associated with your inquiry, and a clear statement that you wish to opt out of arbitration.

Severability. If any part of this arbitration provision is found unenforceable, the remainder shall remain in effect, except that if the Class Action Waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court rather than in arbitration.

10. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute not subject to arbitration under Section 9 shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
